Investigation Underway Youth Dies In Accident - 8 Year Old Boy In Second Grade - Derrick Wayne Herman, 8, of Belleville (formerly of Booneville) was killed in a 4-wheeler accident last Saturday, February 9, 2008 near Lick Creek, west of Havana. Herman was a passenger on a Suzuki 4-wheeler and was thrown off the vehicle after the driver, Anthony Vaughn, 26, of Belleville, lost control on a curve driving down a 20-foot embankment before coming to a stop. Herman was transported to Chambers Memorial Hospital in Danville by Yell County EMS where he was pronounced dead by Dr. William Berry with massive head injuries. Vaughn was injured in the accident and was also transported to Chambers Memorial Hospital where he was released on Monday afternoon.
Yell County Sheriff Investigators said Monday they were questioning Vaughn because of allegations of the possible use of alcoholic beverages while driving the 4-wheeler involved in the accident. Yell County Deputy Prosecutor Eric Wells said that after the law enforcement agencies finish their report, the prosecutor's office would review their findings to determine if any criminal charges were committed in the accident. He said if the prosecutor's office determines criminal charges are warranted then they would request a warrant of arrest for the driver.
School Impacted - Western Yell School Elementary Principal Keith Jones said the school was certainly impacted with the death of one of their students. He said that area pastors were at the school on Monday morning to assist students if needed. Jones said that Herman had only been enrolled at the school since after Christmas break, but, "Derrick fit in very well and became one of the classmates quickly. Nothing but good things could be said about Derrick or his sister, who also enrolled in the school system after Christmas break.
Riding With Another 4-Wheeler - Vaughn was with another 4-wheeler riding from Havana to Kirkwood (south of Havana). Authorities said they met with others at the crossroads west of Kirkwood in the Pea Ridge area when they began riding back toward Havana, north bound on the Pea Ridge road, also located near Lick Creek. Accident investigator Yell County Deputy Sheriff Kenny Poore stated that Vaughn was driving north when he lost control in a curve on top of the hill causing the ATV to veer off the left side of the road down a steep ravine through some trees, rolling over two times before coming to rest on its side. Robert Mitchell, the driver of second 4-wheeler, told authorities that Vaughn possibly was unable to see the curve due to the dust on the road.
Poore said Herman's mother, Rebecca, said she was following the ATV when the accident occurred. Apparently her son was placed in her vehicle. Poore indicated that he was told 911 was called and she then drove to meet the first responders. Danville Fire and Rescue was called to the scene to help bring Vaughn up the embankment to the EMS ambulance.
The driver and passenger of the second 4-wheeler were not involved in the accident. Assisting Poore were Detective David Kimball, Yell County Deputy Dolan Sharp and Lt. Kevin Williams.
